COVID-19 : NOVEL CORONAVIRUS

Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand. 


This update is provided on a weekly basis.


LEGISLATION CHANGES

Federal Financial Relations (National Health Reform Payments for 2019-20) Determination 2021

  • Specifies amounts to be paid to each State, the Australian Capital Territory and Northern Territory, for the 2019-20 financial year. 


Liquor (COVID-19 Emergency Response - Licence Fee Waiver and Reduction) Declaration 2021 (No 1)

  • Allows eligible liquor licences to receive a 50% fee reduction from 1 April 2021 despite its later notification date.

Public Health (COVID-19 Affected Areas) Emergency Direction 2021 (No 7)

  • Among other things, requires certain affected persons who are ACT residents to undertake quarantine and complete a self-declaration form, requires affected persons who are non-residents to obtain an exemption before entering the Territory and undertake quarantine, and requires persons subject to stay-at-home requirements to stay at home and complete a self-declaration form.

Residential Tenancies (COVID-19 Emergency Response) Declaration 2021

  • Continues certain measures from the Residential Tenancies (COVID-19 Emergency Response) Declaration2020 (No 3).



COVID-19 Directions (No. 6) 2021: Directions for Quarantine Workers

  • Requires quarantine workers to submit to testing or undertake mandatory quarantine.


COVID-19 Emergency Response and Other Legislation Amendment Act 2021

  • Amends the City of Brisbane Act 2010, the Local Government Act 2009 and the Local Government Electoral Act 2011 to provide flexibility, if required, to facilitate the holding of a local government by-election or fresh election in a way that minimises serious risks to the health and safety of persons caused by the COVID-19 public health emergency.

Places of Concern Direction (No. 2)

  • Requires certain persons who have been in a place of concern to isolate, quarantine or stay at home, and to wear a face mask, among other things.


Emergency Management (COVID-19) Supervised Quarantine No 8) (COVID-19) Direction 2021

  • Requires certain persons to undergo testing and the operator of a medi-hotel to adopt a testing compliance plan, prohibits employees and contractors who have worked at a medi-hotel from being employed in high-risk settings or locations, and specifies requirements for quarantine facilities and for person undertaking supervised quarantine.

Emergency Management (Residential Aged Care Facilities No 35) (COVID-19) Direction 2021

  • Prohibits the entry of persons into residential aged care facilities except in certain circumstances, limits the provision of personal care by personal care workers to one facility, and requires such facilities to adopt a Workforce Management Plan and COVID-19 Infection Control Plan, among other things.


Care Facilities Directions (No 27)

  • Provides for restricted access to care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 6.00 pm 23 April 2021.

City of Melbourne (Electoral) Amendment Regulations 2021

  • Extends for a further 12 months the period during which alternative candidate nomination processes apply in order to address the health risks posed by the COVID-19 pandemic, and makes other minor amendments in relation to matters that can be provided for by electronic communication.

Restricted Activity Directions (Victoria) (No 13) 

  • Restricts the operation of certain businesses and undertakings in Victoria to address the serious public health risk posed by COVID-19 - came into force at 6.00 pm 23 April 2021.

Stay Safe Directions (Victoria) (No 20)

  • Requires residents of Victoria to limit interactions with others by restricting gatherings, and to carry and wear face coverings in certain settings - came into force at 6.00 pm 23 April 2021.

Victorian Border Crossing Permit Directions (No 10)

  • Continues to provide a ‘traffic light’ border crossing scheme for persons seeking to enter Victoria from any other State or Territory in Australia or, after entering Australia from a Green Zone Country in order to limit the spread of COVID-19 - came into force at 6.00 pm 23 April 2021.

Workplace (Additional Industry Obligations) Directions (No 22)

  • Establishes additional specific obligations on employers and workers in specific industries in relation to managing the risk associated with COVID-19 - came into force at 6.00 pm 23 April 2021.

Workplace Directions (No 25)

  • Limits the number of Victorians attending Work Premises to assist in reducing the frequency and scale of COVID-19 outbreaks in Victorian workplaces, and establishes more specific obligations on employers and workers in relation to managing the risk associated with COVID-19 - came into force at 6.00 pm 23 April 2021.


COVID-19 Response and Economic Recovery Fee Waiver (Parking Charges) Order (No. 2) 2021

  • Waives certain parking charges.

Extension of Declaration (No. 2) of Public Health State of Emergency

  • Extends the public health state of emergency declaration which came into effect on 23 March 2020 for 14 days.

Extension of State of Emergency Declaration

  • Extends the state of emergency declaration made on 26 March 202 for 14 days.

Face Covering Directions (No 2)

  • Requires certain persons to wear face coverings except in certain circumstances.

Presentation for Testing Directions (No 23)

  • Requires certain persons to present for a temperature check or testing.

Safe Transition for Western Australia Directions (No 2)

  • Facilitates a safe transition for the Western Australian community from the stay at home, closure and face covering requirements that came into effect on 23 and 24 April 2021 to a COVID safe re-opening of places and activities so as to limit the spread of COVID-19.

Stay at Home and Closure (Perth, Peel and Rottnest) Directions

  • Requires all persons in the affected areas to stay at home during the stay at home period other than for certain reasons, to close certain places and to prohibit certain gatherings and activities.

Stay at Home (Recent Travel) Directions

  • Extends the application of the Stay at Home and Closure (Perth, Peel and Rottnest) Directions to persons who were in the affected area between 12.01 am on 17 April 2021 and 12.01 am on 24 April 2021 and who have left the affected area prior to the commencement of the Stay at Home and Closure (Perth, Peel and Rottnest) Directions so that those persons are required to stay at home during the stay at home period other than for one or more of the specified reasons.

Visitors to Residential Aged Care Facilities (Stay at Home and Closure (Perth, Peel and Rottnest)) Directions - 

  • Restricts entry to certain residential aged care facilities.


COVID-19 Public Health Response (Air Border) Order (No 2) Amendment Order (No 3) 2021

  • Amends the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.

COVID-19 Public Health Response (Exemption for Quarantine-free Travel) Notice (No 2) 2021

  • Imposes an additional condition on the exemption under the COVID-19 Public Health Response (Exemption for Quarantine-free Travel) Notice 2021, which exempts certain people who arrive in New Zealand on a quarantine-free travel flight from the requirements for isolation or quarantine.

Exemption of Crew from Clauses 17(3)(c), 24(2), 27 and 28 of the COVID-19 Public Health Response (Maritime Border) Order (No 2) 2020

  • Exempts any crew member who arrives in NZ on an aircraft undertaking a QFT flight (within the meaning of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020) is exempt from Clauses 24(2), 27 and 28 of the COVID-19 Public Health Response (Maritime Border) Order (No 2) 2020.

Exemption of Persons from Clause 8(2A), (2B) and (3) and (4) of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020

  • Exempts certain passengers and aircrew arriving in New Zealand on flight ASY302 on Wednesday 21 April 2021 from Clause 8(2A), (2B) and (3) to (4) of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.
